The International Criminal Court (ICC) has issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu, his former defense minister Yoav Gallant, and Hamas leader Mohammed Deif. These warrants stem from alleged war crimes committed during the Gaza war. The court believes that Netanyahu and Gallant may be criminally responsible for causing mass starvation in Gaza by depriving civilians of essential resources like food, water, and medicine. Meanwhile, Deif faces charges related to the murder, torture, and hostage-taking associated with the October 7, 2023 Hamas-led attacks on Israel, which resulted in over 1,200 Israeli deaths and the kidnapping of 250 people.
The arrest warrants have significant implications for Netanyahu and Gallant. If they travel to any country that is a member of the ICC, they risk arrest, as the court relies on member states to carry out such actions. Israel has rejected the ICC’s jurisdiction, denying any war crimes in Gaza and refusing to comply with the court’s orders. Despite this, the ICC has stated that Israel’s acceptance of its jurisdiction is not required for the warrants to remain in effect.
In addition to Netanyahu and Gallant, the ICC also sought arrest warrants for other Hamas leaders, including Yahya Sinwar and Ismail Haniyeh. However, both have been killed in the conflict. Deif’s fate remains unclear, as Israel claims to have killed him in an airstrike, but Hamas has neither confirmed nor denied his death.
The court’s decision has sparked controversy. The United States has criticized the pursuit of Netanyahu and Gallant, contrasting it with its support for ICC warrants against Russian officials for crimes in Ukraine, leading to accusations of double standards from many nations, particularly in the global south. At home, Netanyahu’s critics, including opposition leaders like Benny Gantz and Yair Lapid, have condemned the warrants as unjust. Gantz called the move “moral blindness,” while Lapid labeled it a “prize for terror.”
The ICC’s actions coincide with heightened pressure on Netanyahu’s government, especially as the U.S. works to broker a ceasefire between Israel and Hamas. However, the Israeli leader has refused to compromise on control over strategic territories in Gaza. Netanyahu’s position has strengthened domestically, as many Israelis view the ICC’s jurisdiction as foreign interference in their nation’s internal affairs.
The issuance of these arrest warrants has placed global attention on the conflict’s human toll. Since October 7, 2023, more than 44,000 Palestinians have died in Gaza, according to the Gaza Ministry of Health. Despite this, the Israeli government maintains that its actions are in defense of its citizens and denies the war crimes accusations.
